DATA PRIVACY POLICY

In May 2018 the Data Protection Act (DPA) 1998 of the United Kingdom was replaced by the General Data Protection Regulation (GDPR) (EU) 2016/679. This is a regulation in European Union law on data protection and privacy for all individuals within the European Union.

Our Data Protection Policy has been updated to reflect the new EU regulations.

 

Our Core Privacy Principles.

Nottingham City Motors take our customers and our website users personal data seriously, the following principles underpin our approach to respecting and protecting your privacy:

  • We value the trust that you place in us by giving us your personal data. We will always use your personal data in a way that it was given and intended for.

  • We will provide clear guidance about how we use your personal data. We will always be transparent with you about what data we collect, what we do with it, who we share it with and who you should contact if you have any concerns.

  • We will take all reasonable steps to protect the data you give us from misuse and keep it secure.

  • We will comply with the EU GDPR laws and regulations as well as any National laws which relates to the processing of personal data and we will co-operate with the relevant authorities regarding data protection as and when we are required to do so.

1- Privacy Policy.

For the purpose of this Policy, Nottingham City Motors will be referred to as “NCM” “Us” “Our” or “We”, except in section 9 (Wix). The term “your data” means any information about you from which you are personally identifiable. This Policy explains the types of personal data we collect and how we use, disclose, store and protect that data. Please read the following to understand how we treat your personal data.

2- Your Consent.

By using our website, buying goods or services you are giving consent for the collection, using and disclosing (where necessary) of your personal data in accordance with this Policy. If you do not agree to the collection, usage and disclosure of your personal data in this way, please do not use the this website or otherwise provide us with your personal data.

 

NCM may ask you to provide additional consent if we need to use your personal information for purposes not covered by this Policy. If you provide additional consent, the terms of that consent shall prevail in the event of any conflict with the terms of this Policy.

 

However, please note that we may process your personal data without consent if we have a legitimate reason to do so, provided that such use will not have a prejudicial effect on your own rights, freedoms and interests. Any such use shall be in accordance with the Privacy Principles set out above.

3 - How NCM Collect Your Data.

We will only collect your personal data when you fill out the contact form on our website, when you make a purchase via our website or in person or when you use any of our services which requires giving you a receipt / acknowledgement or other documentation.

4 - What Data NCM Collect.

As mentioned above, “your data” means any information about you from which could allow you to be identified. This includes information such as your name, address, bank details, screen name, profile picture, email address, telephone number and vehicle registration number, but can also include other information such as IP address.

  • details of the web pages you have viewed before coming to our site.

5 - How Do NCM Use Your Personal Data.

We use your personal data for our legitimate interests in order to:

You can opt out of receiving communications from us at any time. Any direct marketing communications that we send to you will provide the information and means necessary to opt out.

6 - Disclosure of Your Data.

We only use you personal data for the intended reason or transaction for which it was given by you., therefore we only disclose you personal data for the intended use at the time, such as our website provider who host our website & online shop, the relevant payment gateway who process any payments from you, we may also share your data with other third parties such as our supplier or our courier or postal service who may be required to supply or deliver any goods or service directly to you that you have ordered.

 

NCM may also disclose your personal data to the Police, regulatory bodies or legal advisors in connection with any alleged criminal offence or suspected breach of the “Terms of Service” or where we are under a duty to disclose or share your data in order to comply with any legal obligations.

 

We may also disclose your data to:

  • enforce applicable terms of use of our website.

  • conduct investigations into possible breaches of applicable laws.

  • detect, prevent and protect against fraud and any technical or security vulnerabilities.

  • comply with applicable laws and regulations, co-operate in any legal investigation and meet enforceable governmental requests.

 

We will not share you personal data with any third party for any other reason except for those mention in this Policy.

 

NCM does not sell, give, share or disclose your data to anyone outside of the chain of providing the intended service or products to you, your data will only be used in the servicing of your order, purchase or request.

7 - Cookies.

NCM website, together with Wix and its marketing, analytics and technology partners, uses certain monitoring and tracking technologies (such as cookies, beacons, pixels, tags and scripts). These technologies are used in order to maintain, provide and improve our Services on an ongoing basis, and in order to provide our visitors, our Users with a better experience. For example, thanks to these technologies, we are able to maintain and keep track of our visitor’s and Users’ preferences and authenticated sessions, to better secure our Services, to identify technical issues, user trends and effectiveness of campaigns, and to monitor and improve the overall performance of our Services.

Such practices are not covered by our website provider Privacy Policy and we do not have any control over them.

“Clear Gifs”: We, our website provider and certain Third Party Services may employ a software technology called “clear gifs” (a.k.a. Web Beacons/Web Bugs), which enables them and us to improve our Services by measuring their effectiveness and performance. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, however are not stored on your device, but instead embedded within our Services.

 

“Flash and HTML5”: We, our website provider and certain Third Party Services may also employ certain tracking technologies known as “Flash cookies” and “HTML5”, mainly for advertising purposes. “User Data Supplementation”: We may receive information about you from other sources, including publicly available databases and combine this data with information we already have about you. This helps us to update, expand and analyse our records, identify new customers, and provide products and Services that may be of interest to you. Where we obtain your Personal Information from these third parties, we ensure that such parties are contractually committed to inform you that your Personal Information will be disclosed to us and we take steps to ensure the accuracy of your Personal Information before using it. 9 – Our Suppliers Data.

NCM will collect details such as a contact name, email address, telephone numbers, bank and courier details in order to contact you about goods and / or services we or our customers have ordered from you, to place further orders and to pay you for the goods and / or services ordered or supplied. We may share your data with our payment platform and our employees to manage our relationship with you, we will keep the personal data for as long as we require your goods and services and for a period of 2 years you provided us with the last goods/services.

10 - Links To Other Websites.

From time to time our website may contain links to and from the websites of third parties. If you follow a link to any of these websites, please note that these websites should have their own Privacy Policies and that NCM do not accept any responsibility or liability for these websites when you leave our Site, we encourage you to read the Privacy Policy or Notice of every website you visit from our site.

11 - Website Provider – Users-of-Users data (your data).

For the purpose of ‘this’ section 11 only, our website provider is referred to as “We” or “Our” as mentioned in section 1. As stated in section 7, by using NCM website, NCM website service provider (wsp-) will have access to your data. Section 6 (users-of-Users information) & section 12 (data retention) of our website provider Privacy Policy states that:

 

  • S6 - We may collect, store and process certain Non-personal and Personal Information of Users-of-Users (“Users-of-Users Information”), solely on our Users’ behalf and at their direction. For example, each of our Users is able to import their e-mail contacts from third party services like Gmail, or otherwise collect and manage contacts via their User Website. Such contacts are then stored with Wix, on the User’s behalf. For such purposes, Wix serves and shall be considered as a “Processor” and not as the “Controller” (as both such capitalised terms are defined in the European Union General Data Protection Regulation) of such Users-of-Users Information. The Users controlling and operating such User Websites shall be considered as the “Controllers” of such Users-of-Users Information, and are responsible for complying with all laws and regulations that may apply to the collection and control of such Users-of-Users Information, including all privacy and data protection laws of all relevant jurisdictions.

 

  • S12 - We may retain your Personal Information (as well as your Users-of-Users’ Information) for as long as your User Account is active, as indicated in this Privacy Policy or as otherwise needed to provide you with our Services. We may continue to retain such Personal data even after you deactivate your User Account and/or cease to use any particular Services, as reasonably necessary to comply with our legal obligations, to resolve disputes regarding our Users or their Users-of-Users, prevent fraud and abuse, enforce our agreements and/or protect our legitimate interests. We maintain a data retention policy which we apply to information in our care. Where your Personal Information is no longer required we will ensure it is securely deleted.

12 - Data Retention.

The data you supply via any of our website “contact” forms will be deleted after the enquiry has been resolved, unless you tick the box “keep info for marketing” then your data will be kept for a period of 3 years. If you make a purchase or use any of our services then you data will be kept for 6 months and then deleted, unless you give your consent for the data to be kept for 3 years and then deleted.

 

All Card, PayPal or Bank payment data will be deleted 6 months after you have paid for products or services.

14 - Data Security.

  • Providing Data - The transmission of data via the internet and mobile networks is not completely secure. Although we will do our best to protect your data, we cannot guarantee the security of your data whilst being transmitted to nottinghamcitymotors.com, any transmission is at your own risk.

     

  • However, Once we have received your data, we will use strict procedures, systems and security features to try to prevent unauthorised access. Information you provide to us is stored on Wix secure servers. We have implemented appropriate physical, technical and organisational measures designed to secure your data against accidental loss and unauthorised access, use, alteration or disclosure. In addition, we limit access to personal data to those employees, agents, contractors and other third parties that have a legitimate business need for such access.

 

  • Data Breach - If there is a breach of our database and our customers information is compromised then we will inform you within 72 hours of NCM becoming aware of the breach, we will inform you of the nature of the breach and give you specific details of what has happened to your data as well on advice on what to do.

15 - Access to, Updating, Deleting and Restricting Use of Your Data.

Data protection legislation gives you the right to see what data a company hold on you, this is known as ‘subject access request’. This right means you can make a request under the GDPR to see what information we hold on you if you have ever accessed our organisation.

 

You can also ask us to update, amend or restrict the use of your data or remove your data from our database entirely.

 

We may request specific information from you to help us confirm your identity and your right to access/provide you with the personal data we hold about you or make your requested changes. Data protection legislation may allow or require us to refuse to provide you with access to some or all of your data/comply with requests made in accordance with your rights referred to above. If we cannot provide you with access to your data, or deal with any other request we receive, we will inform you of the reasons why, subject to any legal or regulatory restrictions.

Please specify your name and the action you would like us to undertake, we will then contact you for more information to confirm your identity. Please note that a fee of £5 will be charged for any request for information relating to your data held by us.

16 - Right to Withdraw Consent.

Where you have provided your consent to the collection, processing and transfer of your personal data, you may withdraw that consent at any time. This will not affect the lawfulness of data processing based on consent before it is withdrawn. To withdraw your consent please send us us an email with your request to: nottmcitymotors@hotmail.com.

17 - Changes to NCM Privacy Policy.

We may change this Privacy Policy from time to time by posting the updated version of the Policy on the our website. We encourage you to refer to the Policy before you use our services or make a purchase from us.

 

Any changes we may make to this Policy in the future will be available via our website. We encourage you to check this privacy policy from time to time for any updates or changes to the Policy. If we want like to use your previously collected personal data for different purposes than those we notified you about at the time of collection, then we will provide you with notice and seek your consent before using your personal data for a new or unrelated purposes. We may process your personal data without your knowledge or consent where required by applicable law or regulation as provided for in this Policy.
